Haley Kalil has scored a major legal victory after a federal judge dismissed a lawsuit filed by her ex-husband, former NFL player Matt Kalil, over her viral comments about his penis size and their sex life.
On Thursday, 17 September 2026, US District Judge Patrick J. Schiltz dismissed Matt's invasion-of-privacy and unjust-enrichment claims with prejudice and on the merits. The former Minnesota Vikings offensive tackle had argued that Haley's remarks exposed deeply private information, subjected him and his family to unwanted attention and allowed her to profit from the publicity.
Judge Says Haley Was Talking About Her Own Life
The dispute began after Haley, a Sports Illustrated model and creator known online as Haley Baylee, appeared on a November 2025 Twitch livestream with Marlon Garcia. While discussing why her marriage ended, she said anatomical incompatibility had been the 'biggest factor' and compared her ex-husband's penis to 'two Coke cans stacked on top of each other. Maybe even a third.'

Matt, the fourth overall pick in the 2012 NFL Draft and a former Pro Bowler, sued in January 2026. He alleged that Haley had publicised intimate facts that were not of legitimate concern to the public, while also claiming she received financial benefits from the attention surrounding her remarks.
Schiltz agreed that Matt had plausibly alleged the comments concerned his private life and 'would be highly offensive to a reasonable person'. But the judge said the deciding question under Minnesota law was whether the information was nevertheless of legitimate public concern.
The court found that it was. Schiltz noted that Haley made the remarks while answering questions about her marriage, health and divorce, rather than simply revealing sexual details about Matt for entertainment.
'Haley was discussing her life, not Matt's,' the judge wrote, adding that the law generally protects people speaking about themselves even when their stories inevitably reveal information about others. The court ultimately found that her comments about Matt's penis size and its alleged effect on her health and marriage were matters of 'legitimate public concern'.
From Viral Livestream to Federal Court
Haley and Matt married in 2015 after meeting while he was playing for the Minnesota Vikings. He later played for the Carolina Panthers and Houston Texans before retiring from the NFL in 2019, while Haley built a career spanning Sports Illustrated modelling, pageantry and social media.
The couple divorced in 2022. During the livestream three years later, Haley repeatedly described Matt as a good person and said the pair had tried doctors and therapists before ending their marriage, according to the court's account of the video.
The judge also rejected Matt's unjust-enrichment claim, finding there was 'nothing unjust' about Haley keeping any benefit she may have received from remarks the court had already found concerned a legitimate public concern. The ruling meant every count against her was dismissed.
Matt Kalil Plans to Appeal
Haley said after the decision that she was 'so relieved this is over' and hoped the ruling would encourage women to speak openly about their own experiences. Her lawyer, Matthew Bialick, said the case concerned her right to describe her own body, marriage and personal history.
The legal fight may not be finished, however. Matt's attorney, Ryan Saba, said his team intends to appeal the dismissal, meaning the ruling could still face review by a higher court.
For now, the federal ruling leaves Haley with a significant legal victory in a case that turned an unusually intimate divorce story into a dispute over celebrity privacy, personal storytelling and who gets to describe a marriage after it ends.
