
A Reddit post titled 'She's going to get away with this, isn't she?' circulated images of Lindsay Clancy at a 29 September hearing in Plymouth Superior Court in Massachusetts. The post appeared in the r/SipsTea subreddit as users reacted to her expression and the possibility of another trial.
The photographs do not establish why Clancy was smiling or how she felt about the proceedings. Her case remains active, and she has not been acquitted.
Clancy, a former labour-and-delivery nurse from Duxbury, is charged with three counts of first-degree murder in the 24 January 2023 deaths of her children, Cora, 5, Dawson, 3, and Callan, 8 months. She pleaded not guilty by reason of lack of criminal responsibility.
Murder Trial Ended With Deadlocked Jury
Clancy's first trial ended in a mistrial on 4 September after jurors failed to reach a unanimous verdict following days of deliberations.
The trial centred on criminal responsibility in the deaths of her three children, whom prosecutors say she strangled with exercise bands in the basement of the family's Duxbury home. She then cut herself and jumped from a second-storey window in what authorities described as a suicide attempt, leaving her paralysed.
Her defence argued that severe mental illness, including postpartum psychosis, meant she lacked criminal responsibility. Prosecutors argued that she understood the wrongfulness of her actions and presented expert testimony supporting criminal responsibility.
The mistrial did not clear Clancy of the charges. Prosecutors have not announced whether they will seek a retrial, while Clancy's defence is challenging the prospect of a second trial.
Judge Rejects Bid for Not-Guilty Finding
Clancy returned to court on 29 September for the hearing shown in the photographs circulating online. Her lawyer, Kevin Reddington, filed a motion for a required finding of not guilty and asked Judge William Sullivan to enter such a finding. Reddington argued that prosecutors had not presented sufficient evidence establishing that Clancy committed the killings or that she was criminally responsible.
Sullivan rejected the request on 1 October. He ruled that prosecutors had presented sufficient physical and circumstantial evidence for a jury to find the elements of murder beyond a reasonable doubt.
The judge also pointed to conflicting expert testimony presented at trial. Prosecutors' experts said Clancy retained the capacity to understand the criminality or wrongfulness of her conduct, while defence experts disagreed.
Clancy remains charged with three counts of first-degree murder. If convicted of first-degree murder, she would face life imprisonment without parole. A hearing is scheduled for 2 November.
Postpartum Psychosis Was Central to the Defense
The high-profile case has drawn widespread attention because of the defence's reliance on postpartum psychosis and the competing expert assessments of Clancy's mental state.
Clancy's lawyers maintained throughout the trial that she was severely mentally ill at the time of the children's deaths. Prosecutors argued that her mental illness did not eliminate criminal responsibility and cited evidence they said showed planning and awareness.
Clancy is being held at Tewksbury State Hospital. Prosecutors have not announced whether they will seek a retrial, while the defence is seeking to block another trial.
